Charity Law

Only a few law firms in Scotland have an in depth experience of charity law. P.C. McFarlane & Co. is one of those firms. We have extensive experience working with several large charities, and we are always interested in expanding our work in this area.

If you are seeking a solicitor to oversee the various legal aspects of your charity, we welcome you to contact our firm.

We take the time to get to know our clients and their organisations, carefully developing customised strategies to address their unique needs and goals.

Edinburgh Solicitors for Charity's

OSCR Requirements and SCIO Incorporation

Our lawyers are active in charity law, and we are very familiar with requirements of The Office of the Scottish Charity Regulator (OSCR). We offer comprehensive advisory services for charities, including:

  • Establishment of new charities
  • Ongoing compliance and regulatory requirements of charities
  • Conversion of charities to Scottish Charitable Incorporated Organisations (SCIOs)

We are particularly interested in the establishment of new style Scottish charitable organizations as SCIOs (Scottish Charitable Incorporated Organizations), a form introduced at the end of 2011. This new type of organisation is custom designed for charities and offers many unique benefits. It allows charities to break free from the traditional structures and is a contemporary solution to establishing a charity.

In one interesting recent instruction, we acted for a large charity in creating internal procurement procedures and protocols.

Another recent task has been to advise a large group of significant charities and not for profit organisations in the foster care sector on the content of a public sector framework designed to form the basis of a tendering process. Public sector procurement is a very specialist field. We have also been grateful to have had recent instructions from a household name childrens' charity and also from a national association in the area of residential care. We also established a mosque as a SCIO. Our charity work is very varied.

We offer free initial consultations to give you an opportunity to meet us, discuss your needs and learn about our approach. Call 01506 668941 or contact us online to schedule a meeting with one of our knowledgeable Livingston charity law solicitors.
